Welcome to the ArtikFest website at www.artikfest.com (the “Site”), which includes all current and future sub-domains, the Zone Festival management platform and the Outbox Ticketing System located at the separate www.outbox.com sub-domain . The Site, the sub-domains and the Ticketing System are collectively referred to as the “Services”. The purpose of this document is to establish the general rules and obligations between FestiVoix and its users, and to describe your rights and responsibilities as a user.

We invite you to carefully read the terms of use of our site below as well as our Privacy Policy. These two documents govern your use of the Services. You are also bound by our General Terms and Conditions of Sale when you use the Ticketing System.

By browsing our Services, you acknowledge that you have read this policy and agree to be bound by these Terms of Use. If you do not agree to these Terms and Conditions or any other ArtikFest policy, please do not use the ArtikFest Services.

 

SITE USE & CONTENT

The ArtikFest Services offer a variety of content designed to inform and entertain our users. You’ll find festival information, blog posts, videos, images and other forms of media covering a variety of topics such as music, art, festivals and more. We strive to provide accurate and up-to-date information, as well as original content created by our team and contributors.

The content available on the ArtikFest Services is intended for personal, non-commercial use only. You may view, download and print portions of the content for your personal use, provided that you do not modify the content and that you retain all copyright and other proprietary notices. Any use of the content for commercial or other unauthorized purposes is strictly prohibited without the prior written consent of ArtikFest.

You may have the opportunity to submit, publish or display content, including, but not limited to, comments, reviews, photos, videos and other materials with FestiVoix-related hashtags, including, for example, #ArtikFest, on third-party websites such as Instagram, Twitter and Facebook (collectively, “User-Generated Content”). By submitting User Generated Content, you grant ArtikFest a worldwide, non-exclusive, transferable, sub-licensable, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display such content in any and all media. You represent and warrant that you own or have the necessary rights to submit such content and that such content does not infringe the rights of any third party.

You agree not to use the site for any unlawful or prohibited purpose. Any illegal or unauthorized use of our website constitutes a violation of our terms and conditions. You may not access our website in any manner that violates these terms and conditions, or any laws or regulations of the United States, Canada or the country from which you are visiting the website. Illegal or unauthorized use of our Web site includes, but is not limited to: (i) using the website in a manner that would facilitate the illegal sale of tickets, copying, modifying, deleting, augmenting, publishing, transmitting, creating derivative works, creating or selling merchandise derived from our content or otherwise exploiting our content, in whole or in part ; or (ii) use any automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to illegally access, acquire, copy or monitor any portion of this Web Site or any network connected to the Web Site or reproduce or circumvent the navigational structure or presentation of the Web Site or any Content.

The names of companies, products, services and logos appearing in the ArtikFest Services may be trademarks registered or not by their respective owners and protected accordingly. It is therefore forbidden to use any trademark appearing on the Services without the prior written authorization of ArtikFest or the holder of the rights to this trademark. To the fullest extent permitted by applicable law, you hereby perpetually and unconditionally release and discharge ArtikFest, its employees, directors, officers, agents or third parties with whom it associates from time to time, from any and all claims or liability arising out of or in connection with User Content submitted by you.

You agree to immediately notify ArtikFest of any unauthorized use of your account or any other breach of security. ArtikFest will not be liable for any loss or damage arising from your failure to protect your account and password.

ArtikFest may, but is not legally obligated to, review, monitor, edit, refuse, restrict or remove any User Content submitted on or through this website at its sole discretion. We reserve the right to suspend or terminate your account at any time, without notice, if we believe that you have violated these Terms of Use or that your behavior is harmful to other users or to the integrity of the site.
You may also terminate your account at any time by following the instructions provided on our site. In the event of termination, your right to use the services will cease immediately.
